1. Scope of Services
1.1 These Terms and Conditions apply to all services provided by Envirosmart Limited, including but not limited to supply, installation, maintenance, and repair work as detailed in the customer’s quotation or service agreement.
1.2 The scope of work will be outlined in writing and confirmed before any work begins.

2. Quotations and Payments
2.1 All quotations are valid for 7 days from the date of issue unless otherwise stated.
2.2 A deposit is required to secure bookings or commence work. The amount and payment terms will be confirmed in the quotation.
2.3 Full payment is required upon completion of the agreed work unless alternative arrangements are specified in writing.
2.4 Envirosmart Limited reserves the right to charge interest or administrative fees for late payments.

3. Service Delivery and Site Access
3.1 The customer agrees to provide reasonable access to the site and to ensure that the working area is clear and safe for Envirosmart Limited personnel.
3.2 Scheduled work may be postponed or rescheduled due to weather conditions, supply delays, or other unforeseen circumstances. Customers will be notified promptly of any changes.

4. Materials and Workmanship
4.1 All materials used will be of appropriate quality and suitable for the intended purpose, subject to natural variations.
4.2 Envirosmart Limited will carry out work with reasonable care and skill in accordance with industry standards.
4.3 Unless otherwise stated, any estimates for delivery or completion dates are approximate and not guaranteed.
4.4 Services are weather permittent.
4.5 Resin Surfaces
• Resin surfaces must be kept free from vehicles for at least 48 hours after installation.
• We are not responsible for damage caused by early use, pressure washing, or use of incompatible cleaning chemicals, heavy vehicles, poor maintenance, wildlife-related damage, wear and tear from normal usage beyond the guarantee period.
• Due to the nature of resin-bound surfacing and how it reacts to lighting and curing conditions, minor trowel marks or surface variations may not be visible until the resin has fully cured. These marks are often a normal part of the hand-trowelled finish and do not affect the performance, durability of the surface. While every effort is made to achieve a smooth and consistent finish, we cannot guarantee the complete absence of such marks, especially when reviewed under certain lighting angles and conditions.

5. Guarantees and Warranty
5.1 Workmanship is guaranteed for a minimum period of 2 years unless otherwise specified in the contract.
5.2 Materials may be covered by separate manufacturer warranties. Details will be provided where applicable.
5.3 Guarantees exclude damage caused by misuse, neglect, third-party interference, ground movement, or conditions outside Envirosmart Limited’s control.
5.4 Proper aftercare and maintenance must be followed to keep any warranties valid.

6. Customer Responsibilities
6.1 The customer is responsible for obtaining any required permissions (e.g., planning, landlord, or homeowner association approval).
6.2 The customer must inform Envirosmart Limited of any known risks, hazards, or site-specific considerations prior to the start of works.
6.3 Any delays caused by the customer may affect completion timelines and result in additional charges.

7. Cancellations and Refunds
7.1 Customers have a statutory right to cancel within 14 days of entering into a contract (cooling-off period).
7.2 Cancellations must be made in writing.
7.3 If work begins before the end of the 14-day period at the customer’s request, any reasonable costs incurred up to that point will be deducted.
7.4 Cancellations made after work has commenced or outside the cooling-off period are non refundable. and may also be subject to additional charges for time set aside to allow us to complete the work, materials ordered, and/or services already provided and travel to and from the location.

8. Limitation of Liability
8.1 Envirosmart Limited holds full public liability insurance.
8.2 We are not liable for:
• Pre-existing issues or structural problems
• Third-party damage or interference
• Acts of nature or conditions beyond our control
8.3 Any incidental damage to nearby surfaces, landscaping, or underground features will be assessed reasonably and dealt with where fault is proven.

9. Disputes and Complaints
9.1 All concerns must be reported in writing as soon as possible.
9.2 Envirosmart Limited will make reasonable efforts to resolve issues amicably and in a timely manner.
9.3 Both parties agree to attempt resolution through communication or mediation before pursuing legal action.

10. Right to Remedy
10.1 Customers must give Envirosmart Limited the opportunity to resolve any faults, complete unfinished work, or correct mistakes before engaging third parties.
10.2 Failure to allow access or prematurely involving another contractor may void warranties and may result in claims for loss or damages.

11. Force Majeure
11.1 Envirosmart Limited is not liable for any failure or delay in performing its obligations due to events beyond its control, including extreme weather, acts of God, supply shortages, or industrial disputes.

12. General Terms
12.1 These Terms and Conditions represent the entire agreement between Envirosmart Limited and the customer, unless otherwise agreed in writing.
12.2 Any amendments or additions must be confirmed in writing by both parties.
12.3 Envirosmart Limited reserves the right to update these Terms from time to time. The version in effect will be the one issued with the quotation or contract.
